Terms of Service

License

SagaMail is licensed, not sold. A valid license grants you a non-exclusive, non-transferable right to use the application on your personal devices. Each license is tied to one user account.

License Types

• Free — No cost. For personal use with up to 3 email accounts.
• Pro — One-time purchase. Unlimited accounts, lifetime updates for the major version purchased.
• Business — Per-seat volume licensing for organizations of 3 or more seats, with centralized license management.

During early access, all features are available in every plan. Tier enforcement arrives in a future update.

Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the application
• Share, resell, or redistribute your license key
• Use the application for unlawful purposes
• Attempt to circumvent license validation
• Send unsolicited bulk email (spam) or commercial mail in violation of CASL, CAN-SPAM, GDPR, or any other applicable anti-spam law
• Distribute illegal, infringing, harassing, defamatory, or malicious content
• Impersonate any person or entity, or misrepresent the origin of an email by falsifying headers, sender names, or reply-to addresses

AI Features

SagaMail's AI features (writing assistant, Smart Compose, summarization, AI Chat, calendar extraction, PHIPA scanning) operate on a Bring Your Own Key basis. You are solely responsible for:

• Obtaining and paying for your own API key from Anthropic, OpenAI, Google, or another supported provider
• Complying with the terms of service, acceptable-use policy, and content policy of your chosen AI provider
• Any costs you incur with that provider as a result of using AI features in SagaMail

SagaMail does not guarantee the availability, accuracy, completeness, or reliability of AI output. AI-generated text may be inaccurate, biased, or otherwise unsuitable for your purpose. Always review AI output before sending.

PHIPA & Healthcare Compliance

SagaMail's optional PHIPA scanning feature is provided as an assistive tool to help users identify potential Personal Health Information in outgoing email. It does not guarantee compliance with PHIPA, HIPAA, PIPEDA, or any other healthcare privacy regulation.

Users who operate in regulated healthcare environments are solely responsible for their own regulatory compliance, including obtaining appropriate consent, implementing organizational safeguards, conducting privacy impact assessments, and ensuring that any AI provider used with SagaMail satisfies their custodial obligations. Vohux Inc. is not a Health Information Custodian and is not your Business Associate.

Web App

Access to app.sagamail.app requires a valid license and account registration. We reserve the right to suspend accounts that violate these terms. Your account data will be available for export upon request.

Refunds

We offer a full refund within 30 days of purchase, no questions asked. Contact info@vohux.com.

Disclaimer

SagaMail is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. Use at your own risk.

Limitation of Liability

To the maximum extent permitted by law, Vohux Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenue, or business, arising out of or in connection with your use of SagaMail. This includes, without limitation, liability for:

• Email delivery failures, delays, or misdelivery
• Loss, corruption, or unauthorized access to email data
• Service interruptions or downtime of email providers, AI providers, or update servers
• Errors, omissions, or inaccuracies in AI-generated output
• Third-party service outages affecting authentication, sync, or breach monitoring

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, the above limitations may not apply to you, and our liability shall be limited to the greatest extent permitted by law. In no event shall our aggregate liability exceed the amount you paid for your SagaMail license in the twelve months preceding the claim.

Governing Law

SagaMail is published by Vohux Inc., a Canadian corporation. These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. The courts located in Toronto, Ontario shall have exclusive jurisdiction over any dispute arising out of or relating to these terms.
